`Education is service under consumer Act'

NEW DELHI, FEB. 2. The imparting of education by an educational institution for a consideration falls within the ambit of `service' under the Consumer Protection Act, the National Consumer Disputes Redressal Commission has said in a recent order.

The Commission, headed by D. P. Wadhwa, held that fees were paid for services rendered by way of imparting education. If there was no rendering of service, the question of fee payment would not arise. The complainants, who had hired the services of such institutions for a consideration, were consumers as defined under the CP Act.

The Commission gave the ruling while disposing of a revision petition filed against an order of the Kerala State Consumer Disputes Redressal Commission which had said education would not fall within the ambit of the Act.

According to the complainant, M. Ravindranath, his daughter applied for admission to B.Sc., Maths, in 1992 in a college in Palakkad. She was admitted to the Chemistry group on the assurance that she would be given a seat in the Maths group if there was a vacancy. But, when vacancies arose, she was not given a seat. Four or five other students were admitted to Maths instead.
