When the senior counsel, G. Rajagopalan, submitted that the returning officers of Bhuvanagiri and Pudukottai informed the Commission that there was no suppression of facts by Ms. Jayalalithaa and that there was no need for any action, the Bench asked him to file their statements in the form of an affidavit. A Division Bench comprising Justice R. Jayasimha Babu and Justice A. Kulasekaran then posted the petition, filed by the DMK MP, C. Kuppusamy, for further hearing after vacation. Mr. Kuppusamy had alleged that despite an EC communique asking the Chief Electoral Officer in Tamil Nadu to ``examine the matter (pertaining to Ms. Jayalalithaa's nominations) for appropriate action'', the latter did not act against her.
