A Bench, comprising Justice S.S.M. Quadri and Justice S.N. Variava, today adjourned the hearing to Thursday when a connected matter will be heard. In its SLP, the State Government contended that common entrance test (CET) was introduced for MBA and MCA with a view to ensuring admission for meritorious candidates and at the same time to eliminate capitation fee. Pointing out that there were irregularities in the fixation of tuition and development fees by the private colleges, the Government introduced the SWS to remedy these irregularities. It further submitted that of about 300 colleges (with a total intake of about 35,000 students), only 30 had challenged the SWS and the remaining institutions had accepted the SWS and were awaiting allotment of students to their colleges. It said unless the SWS was introduced, the policy guidelines of the Government of India would not materialise and collection of exorbitant amount as capitation fee could not be eliminated, resulting in meritorious students not getting admission in the college of their choice. The SLP said the High Court had erred in holding that the State Government had no independent power to hold a CET and admission had to be done within the framework of the guidelines prescribed by the All-India Council for Technical Education. Unless interim stay of the impugned judgment dated July 3 was granted, great prejudice would be caused to the students, the SLP said and prayed for an interim stay of the operation of the High Court judgment. A direction to permit the State Government to conduct the CET for MBA/MCA courses for the year 2002-2003 and admit students through SWS was also sought.
