A Bench comprising Justice R.C. Lahoti and Justice Brijesh Kumar asked the petitioner, Bhim Singh, party president, to approach the High Court for relief. The petitioner contended that the Commission had not prepared the electoral rolls properly and as a result over 25 lakhs eligible voters could be deprived of exercising their franchise. Also, the delimitation of the constituencies had not been carried out properly. As per Sec. 47 of the Jammu and Kashmir Constitution, the delimitation of the constituencies had to be carried out after every census. This would mean that after the 2001 census there should be a delimitation but this had not been done in the State, he said and sought a direction for proper delimitation of the constituencies before holding the Assembly polls.
