SC to hear petition against Kalam on Nov. 25

NEW DELHI NOV. 22. The Supreme Court will hear on November 25 an election petition against the President, A.P.J. Abdul Kalam, challenging the requirement that there must be 50 proposers and 50 seconders for anyone to file nomination to contest the Presidential election on the ground that it violated the Constitutional provisions.

A five-Judge Constitution Bench, comprising the Chief Justice

G.B. Pattanaik, Justice V.N. Khare, Justice K.G. Balakrishnan, Justice Ashok Bhan and Justice S.B. Sinha, while adjourning the hearing asked petitioner Charan Lal Sahu whether he was serious in pursuing the petition.

When the petitioner said that he wanted to pursue the matter, the Bench directed listing of the matter before a Bench of which Justice Sinha was not a member.

In July, as Chief Justice of the Delhi High Court, Justice Sinha had dismissed Mr. Sahu's petition challenging the rejection of his nomination papers for the post of President and seeking postponement of the election. The court held that it was beyond its jurisdiction to entertain a writ petition against a Presidential election and imposed Rs. 20,000 costs on the petitioner. The present appeal is directed against the order.
