Solid waste management: 4 weeks for Centre to respond

NEW DELHI Jan. 14. The Supreme Court today granted four weeks time to the Centre to file its response on a comprehensive plan for municipal solid waste management in major cities in the country and for marketing urban compost as an alternative to fertilizers.

A Bench, comprising Justice Y. K. Sabharwal and Justice H. K. Sema, suggested that as the matter involved serious issues pertaining to the cleanliness and health of millions of urban-dwellers, either the Attorney-General or the Solicitor-General should be present during the next hearing to assist the court.

Counsel for the petitioner, Almitra H. Patel, submitted that almost three years ago a suggestion was made that the Central Finance Commission would fulfil its obligations under Article 280 (3) (c) of the Constitution to augment the resources of municipalities.

Counsel said that ``this should be done through the release of any undisbursed funds from the 10th Finance Commission, grants and from adequate financial provisions by the 11th Finance Commission including funds for solid waste management and other means''.

The Bench asked the Centre whether it could ensure adequate funding as outlined in the expert committee's report, for their contribution to the cleaning of urban India.
