PIL on Delimitation Act admitted

NEW DELHI APRIL 12. The Delhi High Court has admitted a public interest litigation petition challenging the Delimitation Act, 2002, which provides for revision of reserved seats for the Scheduled Castes and the Scheduled Tribes in the Lok Sabha and State Assemblies on the basis of Census figures of 1991.

Admitting the petition filed by Kiran Singh, who had fought and lost the last Delhi Assembly election as an independent candidate from Mehrauli, a Division Bench of the Court, comprising the Chief Justice, Justice B.C. Patel, and Justice B.D. Ahmed, said the matter needed adjudication on the question of law regarding the legality and validity of Sections 8 and 9 of the Delimitation Act, 2002. The Bench admitted the petition keeping in view the provisions of Articles 82 and 327 of the Constitution which said that only Census reports shall be the basis for readjustment of Lok Sabha and Assembly seats and the delimitation of constituencies thereof.
