Orders reserved on Azhagiri bail plea

CHENNAI JULY 22. The Madras High Court today reserved orders on a bail petition filed by the DMK president, M. Karunanidhi's son, M.K. Azhagiri, who was arrested on May 21 in connection with the murder of former DMK Minister, T. Kiruttinan.

Justice V. Kanagaraj reserved his orders without mentioning any date, after hearing the senior counsel, N. Natarajan, and the State public prosecutor, I. Subramaniam.

Mr. Natarajan submitted that when the police went to arrest Mr. Azhagiri, only the FIR and an inquest report accompanied the remand report. The inquest report quoted Kiruttinan's wife, brother and nephew as saying that they were informed that a conspiracy to murder the DMK leader was hatched at Mr. Azhagiri's house on May 19. How come all three witnesses failed to bring the matter to the notice of anyone, the senior counsel wondered.

Stating that the investigation was poor, Mr. Natarajan alleged that authorities fixed an accused and then invented stories to justify the arrest.

On the prosecution allegation that during the conspiracy period, Mr. Azhagiri made seven phone calls to an accused, he said during the period the petitioner made more than 500 calls as party elections were in full swing. Being a public figure, Mr. Azhagiri would not abscond, as "people were his assets and he would have to work among them," Mr. Natarajan said, adding that an individual could not possibly tamper with witnesses.

The public prosecutor said there was credible material, in the form of letters and diary entries, to indicate a strong motive for Mr. Azhagiri to conspire against Kiruttinan. The investigation was still on and two more accused were yet to be apprehended. Bloodstained clothes, weapons and vehicles used for the murder were recovered by the police, Mr. Subramaniam said.

The original cover of a cellphone, which was extensively used immediately before and after the murder of the DMK leader, was recovered during a search of Mr. Azhagiri's house, he said.
