PIL against duty exemption to Tendulkar adjourned

KOCHI Aug. 25. A Division Bench of the Kerala High Court today adjourned the hearing on the public interest litigation (PIL) challenging the customs duty exemption granted to Sachin Tendulkar, cricketer, for a Ferrari car gifted by the Fiat company.

When the petition came up before the Bench, comprising the Chief Justice J.L. Gupta and Justice A.K. Basheer, counsel for the petitioner informed the Bench that he had received an instruction that a petition had been moved before the Supreme Court for transferring it to the apex court.

The court then ordered that the petition be listed for hearing as and when counsel moved the application. The petition, filed by Sanu Joe Mathew of Thiruvananthapuram, said that the exemption given was illegal and discriminatory. Section 25 of the Customs Act empowers the Centre to waive the duty on imported goods if it was satisfied that exemption should be given in public interest.
