BANGALORE, FEB. 12. The Chief Minister, S.M. Krishna, told the Legislative Assembly today that the question of the establishment of a Bench of the High Court in north Karnataka should be viewed in an objective manner as the Government could only request the Centre and the Chief Justice of the High Court to set up a Bench, but could not put pressure on them. Replying to points raised by members after his reply to the discussion on the budget estimates for 2004-05, Mr. Krishna explained the efforts made so far and said the ball was now in "their court" (the Chief Justice and the Centre). In such a situation there was nothing that the Government could do. The State had certain limitations under the Constitution and it could only set up special courts. It had set up two such courts at Parappana Agrahara here with the consent of the Chief Justice of the High Court. One more had to be set to take up a case relating to the Tamil Nadu Chief Minister, Jayalalithaa, as directed by the Supreme Court and the Chief Justice of the High Court had agreed to it. However, as far as the establishment of a Bench of the High Court was concerned, the State could only request the Centre and the Chief Justice. The question, therefore, had to be viewed objectively and the Government could not be blamed as it had made all efforts. It was also ready to increase the allocation for the Bench.
