Police failed to make proper enquiries: SHRC

CHENNAI, FEB. 22. The Tamil Nadu Government has issued an order for payment of a compensation of Rs. 50,000 to a person of Tirunelveli district for human rights violation committed by two police personnel, one of them an inspector. The order also said the amount should be recovered from the salaries of the erring officials.

The Government acted on an order passed by the State Human Rights Commission following a complaint by Ariyamuthu of Kooniyur.

In his complaint, Mr. Ariyamuthu, a horticultural graduate and employed in a company in Bangalore, said that in December 2002, the police took him to the Ambasamudram police station stating that they were executing an arrest warrant issued by a court in Ernakulam (Kerala). Despite repeated requests, the police did not show him the warrant. At the station, he was shown the warrant, but to his shock he found that the name in it was not his. He was detained in the station and tortured. Mr. Ariyamuthu was set at liberty by a Kerala court after it perused the documents.

In his order, the Commission Member, S. Sambandham, said that the police had not enquired properly. They acted with mala fide intentions. Holding that there was rights violation, he directed the Government to initially pay a compensation of Rs. 50,000 and said the amount should be recovered from the salaries of K. Kandasamy, inspector, and Narayanan, head constable.

Accordingly, the Government issued the order sanctioning the payment of compensation to the victim and also that Rs. 25,000 be recovered from each of the two officials at Rs. 1,000 a month from their salaries.

The police authorities were also ordered to issue suitable instructions to the Superintendent of Police to expedite departmental action against the personnel.
