Judgment reserved on status of Sainik Farms

NEW DELHI, MARCH 19. The Delhi High Court today reserved its judgment on two separate petitions urging the Court to decide the status of South Delhi's posh unauthorised colony, Sainik Farms.

While the public interest litigation filed by Rajeev Malhotra sought demolition of the unauthorised houses owned by the who's who of the Capital, the Delhi Sainik Co-operative Society urged the Court to direct the Union Government to regularise the houses built on a green belt.

A Division Bench of the Court comprising Justice B.C. Patel and Justice B.D. Ahmed reserved the judgment after counsel for the Union Government and the petitioners concluded their arguments on their respective pleas.

The Government through its counsel has already informed the Court that it has no plan to regularise the colony as the houses there have been constructed in violation of the Master Plan.

Counsel for the Delhi Sainik Co-operative Society submitted that the land belonged to the Society as its had been allotted to it, therefore, the constructions there should be regularised.

However, the Government opposed the plea saying that the Society had not been allotted the land, rather the members of the Society had bought the land from farmers. The Municipal Corporation of Delhi, which had earlier passed a resolution urging the Centre to regularise the unauthorised posh colony, is also for demolition of the illegal houses.

Counsel for the Corporation has assured the Court that the civic body will abide by whatever decisions the Union Government takes on the issue.
