NEW DELHI, MARCH 29. The Supreme Court today stayed all further allotment of seats for the post-graduate medical courses in the all-India competitive entrance examination held on January 11. A three-judge Bench, comprising Justice R.C. Lahoti, Justice Ashok Bhan and Justice Arun Kumar, stayed the allotment of seats in the counselling which ended today and referred the matter to a Constitution Bench of five judges. The Bench passed the order on a petition filed by a medico alleging that the Centre had not implemented the Constitution Bench judgment of November 4, 2003 by which 50 per cent of seats in the PG medical courses was directed to be reserved for all-India quota and the remaining 50 per cent for "institutional preference" candidates. The petitioner, Dr. Saurav Chaudry, contended that the Centre had adopted the same policy which it adopted last year under which 25 per cent of the seats was reserved for the all-India quota and the remaining 75 per cent for "institutional preference" candidates. Contending that such a procedure was in violation of the Supreme Court judgment, he wanted that allotment of seats should be done in the ratio of 50 per cent for all-India quota and 50 per cent for "institutional preference." The Centre today filed an application on the last date of counselling stating that it should be permitted to adopt for this year the same policy that was in force prior to the Constitution Bench judgment since the notification for admission was issued on October 27, 2003.
