Notice to Government on plea to quash district judges selection

NEW DELHI, JUNE 29. The Supreme Court on Monday issued notice to the Madras High Court Registrar-General on a petition seeking to quash selection of district judges in Tamil Nadu by direct recruitment and on promotion.

A vacation Bench consisting of Justice K.G. Balakrishnan and Justice P. Venkatarama Reddi issued the notice after hearing senior counsel for K. Asokan and 16 other additional district judges.

The petitioners submitted that they were appointed district munsifs/judicial magistrates in the Tamil Nadu Judicial Service and later promoted additional district judges and posted to work in fast track courts. They were expecting to be promoted and posted in 20 district judge vacancies. But the High Court decided to fill them through direct recruitment (10) and promotion (10) and the petitioners were asked to express their willingness to take a written examination for promotion.

The procedure was illegal, they contended.

Counsel T. Nageswara Rao contended that the apex court in the All-India Judges Association case had categorically said district judges should be recruited on the basis of promotion among civil judges (50 per cent); a competitive examination for civil judges having not less than a five-year qualifying service (25 per cent) and direct recruitment from eligible advocates (25 per cent). The High courts were also directed to frame appropriate rules, he said. But the Madras High Court took a hasty step to fill the vacancies. The written test was held on June 27.

The petitioners sought a direction to call for records from the High Court on the selection, to ask the High Court and the State Government to frame rules according to the apex court judgment and to stay the further process of selection.
