Rice seizure: documents summoned

BANGALORE, JULY 5. The Karnataka High Court on Monday summoned from the trial court in Mangalore all records pertaining to the seizure of rice from godowns in the New Mangalore Port.

A Delhi-based company, Sharp Menthol Export India Ltd., had filed a petition in the High Court challenging the order of the trial court.

The trial court had directed the Government to auction the rice. The Government had challenged this order in the Mangalore Sessions Court.

In its statement, the Government said the rice, if auctioned, would again end up with "interested" parties. The Government sought possession of the rice as it wanted to distribute it to the poor through the public distribution system (PDS) and to people in drought-affected areas.

Justice S.R. Bannurmath summoned all the records.

Meanwhile, the bail petition of three accused in the rice diversion case came up for hearing today.

The main accused, Jagadish, who is the owner of Guru Binny Rice Mill, and two others, Prakash, a mill employee, and Jayaram Kamath, the owner of Kamath Godown in Mangalore, moved the court for anticipatory bail after a Mangalore court rejected their bail plea.

Justice Majage directed the Government to file within 10 days objections to the bail petition.

Notice

A Division Bench comprising the Chief Justice, N.K. Jain, and Justice Ajit J. Gunjal, ordered issue of notices to D. Sudhakar of Challakere, Chitradurga, and others on an appeal field by the State Government.

The Government urged the court to set aside the June 29 order of a single judge regarding excise rent payable from July 1 to July 31, 2004.

Sudhakar and others had challenged the June 19 notification of the Excise Department directing retail excise vendors to pay 15 per cent more rental during July than they were paying. A single judge had reduced it to 10 per cent.

The Government said it could not hold excise auctions though the excise year ended on June 30 as the Government had changed. However, it had decided as an interim measure to continue with the existing vendors and asked them to pay 15 per cent more rental.

It said many vendors had agreed to pay the increased rentals and it was reasonable.

The Bench adjourned further hearing.
