CHENNAI, SEPT. 8. A Division Bench of the Madras High Court today granted an interim stay on rallies taken out to immerse Vinayaga idols made of plaster of paris or other chemical materials. An interim injunction to this effect was granted by the Bench comprising Justice M. Karpagavinayagam and Justice S. Ashok Kumar, on a public interest litigation petition filed by an advocate, Elangovan. When the matter came up for admission, S. Duraisamy, counsel for the petitioner, said despite a specific order of the First Bench to the State Pollution Control Board last year, nothing had been done to prevent the large-scale preparation of plaster of paris idols. Mr. Justice Karpagavinayagam felt that those with true faith in god and religion would not appreciate any pomp and colour in spiritual functions. He said Vinayaga idols should be made only in clay as that alone would be sombre and in consonance with nature. "Using plaster of paris to make the idols first, and then breaking them into many parts for the purpose of immersion into the sea, is not at all appreciable," the judge noted. The Bench then admitted the petition, and ordered notice to the Government. Posting the matter to Friday for further hearing, it said the authorities should take steps to execute the order passed by the court last year. On Friday, the Government is to file a counter-affidavit detailing the efforts made to comply with the order, along with the measures envisaged for the coming Vinayaga Chathurthi festival.
