NEW DELHI, MARCH 7. The Bharatiya Janata Party councillor and Standing Committee Member in the Municipal Corporation of Delhi, Vijender Kumar Gupta, has urged the Lieutenant-Governor, B.L. Joshi, to direct the Congress Government in the Capital to withdraw the proposal to waive off the necessity of sanction of building plan for construction of government buildings like schools, police stations, courts and prisons. According to Mr. Gupta, the Delhi Government's accusation that MCD officials took bribe for clearing building plans was totally baseless and the Corporation was ready to get it probed by the Central Bureau of Investigation (CBI). The Delhi Government's proposal was a case of clear-cut contravention of the provisions of the Delhi Municipal Corporation Act enacted by the Central Government, he added. The provision of Section 332 of the DMC Act, 1957 provides that no person shall commence work on any building or execute any of the works specified in Section 334 except with the previous sanction of the Municipal Commissioner, said Mr. Gupta, adding that besides, the provisions of Section 330 A of the DMC Act, 1957 inter alia provide that the Commissioner shall exercise his powers and discharge his function under this Chapter under the general superintendence, direction and control of the Central Government. "If these provisions are read together, it is clear that the ultimate responsibility for corruption in the MCD, as alleged by the Delhi Government's Public Works Department, lies upon the Central Government since it is due to its lack of superintendence, direction and control," the BJP leader said adding that abolishing the necessity of sanction of building plan on such allegations and lame excuses were politically motivated and aimed at tarnishing the image of the Corporation.
