Doctors denied advance bail

'Kidney removed without consent'

MADURAI.: The Madurai Bench of the Madras High Court on Saturday denied anticipatory bail to a nephrologist and an urologist, visiting consultants at a private hospital in Tiruchi, for removing the kidney of a lorry driver without his consent for commercial gain.

Considering the grave nature of the crime and after perusing the first information report, Justice M. Chockalingam dismissed the joint bail application by the doctors. The Thillai Nagar police in Tiruchi registered a case against six persons including Venkatesan of Chennai, alleged to be a "kidney broker," a woman from Tiruchi, who benefited by the donated kidney, and the doctors. They were booked under Sections 9, 18 and 19 of the Transplantation of Human Organs Act, 1994.

According to the complainant, Bhagyam of Sengundrapuram of Virudhunagar, the " broker" approached her husband, Yesunadhar, and promised him Rs.1.5 lakhs and a job abroad if he donated his kidney to the Tiruchi woman.The poor couple agreed to his offer.

Forcible admission

But after reaching Tiruchi the couple changed their mind and wanted to back out of the proposal.

However, they were forcefully taken to the Government Rajaji Hospital here and produced before the Authorisation Committee constituted under the act. The committee sent them back without asking any question, the complainant alleged.

Yesunadhar was forcibly admitted to the Tiruchi hospital and his kidney removed. The doctors offered only Rs.45, 000 towards the donation.

When she refused, they abused her, Bhagyam alleged.
