Constable ordered to pay compensation

CHENNAI: The State Human Rights Commission has recommended a compensation of Rs.25, 000 to a woman assaulted by a police constable.

Passing order on a complaint filed by the woman's husband, Commission Member S. Sambandham said the Tamil Nadu Government should pay the compensation immediately to the victim and recover it from the constable's salary and terminal benefits.

Mr. Sambandham said that since a charge sheet was filed against the constable, he was not recommending a separate prosecution. Viswanathan of Kurumbapalayam, S.S.Kulam, Coimbatore, lodged a complaint with the SHRC that his wife, Chandra, and her sister were returning after offering worship when a constable, Meikirthi, attached to the Kovilpalayam station, stopped them. (Witnesses' evidence was that the policeman assaulted the woman after asking her to produce the driving licence.) The constable also snatched a gold chain from Chandra. She was admitted to the Coimbatore Medical College Hospital.

The complainant said the police were not interested in investigating the matter.

The policeman said the Kovilpalayam police had filed a case against him. The charge sheet was filed. The case was pending before the Judicial Magistrate-II, Coimbatore. Hence the case before the Commission was not maintainable.

Mr. Sambandham said the respondent, a constable, should give protection to innocent people. Even if the woman did not have a driving licence, he could have asked her to produce it. Chandra knew the policeman and his wife for long. While in the wound certificate issued to Chandra, the name of the assailant was not mentioned, the photocopy of the certificate issued to the constable stated that the victim was assaulted by an unknown person. The trial court should go into these points.
