BANGALORE: The Karnataka High Court on Tuesday rejected a criminal revision petition by the former Director-General and Inspector-General of Police C. Dinakar seeking to quash the proceedings and issue of process against him by a lower court. On March 7, a lower court had taken cognisance of a complaint against Mr. Dinakar by former Director-General of Police S. Krishnamurthy and ordered issue of process. In his complaint on December 18, 2004, Dr. Krishnamurthy had said Mr. Dinakar had accused him of killing a construction worker Murugan following a dispute over money. He said Mr. Dinakar had written to the State Home Minister and National Human Rights Commission (NHRC) in this regard. Dr. Krishnamurthy said Murugan was shot dead by a guard when the latter and two others attempted to burgle his house. A City Metropolitan Magistrate had taken cognisance of the complaint and ordered issue of process against Mr. Dinakar. Mr. Dinakar had said the lower court had erred in issuing the summons, as it had not examined the complainant on subsequent dates. Moreover, the complaint was filed in 2004, though the letters were dated in 2001. Justice Mohan Shantangouder said there was no procedural irregularity by the trial court.
Notice
A Division Bench on Tuesday ordered issue of notices to Commissioner of Bangalore Mahanagara Palike, Bangalore Development Authority (BDA) and the State Government on a public interest litigation. The petitioners prayed for a direction to the authorities to declare a civic amenity (CA) site on No. 7 in 1st Block, HRBR Layout, to be reserved for a park only. They urged the court to ensure that the CA site is not used for any other purpose. They said the BMP had already earmarked Rs. 12 crores for the site. The Bench adjourned further hearing.
Emergent notice
A Division Bench comprising Justice R. Gururajan and Justice C.R. Kumaraswamy on Tuesday ordered issue of notice to the Finance Department and the Bangalore Turf Club on an appeal by the Karnataka Race Horse Owners' Association. According to the appellants, on July 2, 1985, the Government issued an order under the Race Course Licensing Act completely banning racehorse owners from becoming stewards in the committee managing the BTC. The Government contended that it had enacted the ban, as there were allegations of malpractices in races. After the then Police Commissioner submitted a report, the Government banned racehorse owners from becoming stewards in the managing committee. A single judge had dismissed the petition by the association, which had appealed against it. The Bench ordered issues of emergent notices and adjourned further hearing.
