State penalised for failure to file counter

Hyderabad: A Division Bench of the High Court imposed costs of Rs. 2,000 upon the Government for not being able to file counter affidavit in time in a writ petition wherein serious allegations of violation of Coastal Regulation Zone (CRZ) notification at Visakhapatnam were levelled.

The bench comprising Chief Justice G. S. Singhvi and Justice R. Subhash Reddy was dealing with a writ petition filed by Samatha, a voluntary organisation, and Fishermen Youth Welfare Association. The petitioners alleged that a hill is being dug and forest being cleared within CRZ area in violation of the notification. When the case came up for hearing on Monday the Government sought time to file counter affidavit.

The bench felt that enough time has already been granted and counter affidavit is needed in view of the serious issues of public importance and granted two weeks time to file counter affidavit and made it clear that Rs.2000 has to be deposited within 10 days.
