Court relief to schools in Bangalore

Some of them were accused of violating policy on medium of instruction

BANGALORE: Several schools accused by the State Government of violating the policy on medium of instruction, heaved a sigh of relief when the Karnataka High Court rejected an application for vacating a stay the court had granted earlier on withdrawing recognition to these institutions.

The High Court had last month stayed till further orders, the orders of the Education Department withdrawing recognition to some schools. The State had initiated the action after it found that these institutions had neither accepted the voluntary scheme formulated by it nor filed affidavits in the High Court undertaking to teach in the medium of instruction in which they had been granted permission.

The State had filed an application for vacating the stay. The State contended that these institutions could neither claim the benefit of the voluntary scheme or the High Court order. It said the High Court order applied only to schools that are members of Karnataka Unaided Schools Management Association (KUSMA) and other schools and associations that had approached the High Court.

The petitioners countered the Government stand, saying that the interim order passed by a Division Bench comprising Chief Justice Cyriac Joseph and Justice B.S. Patil applied to all schools and that they too had opted for the voluntary scheme after it was extended by the Government.

Justice Patil, who heard the matter, rejected the application saying that any action in closing down the institutions would lead to hardship of the students. He also observed that the Division Bench order did not specify that it would apply only to the petitioners.
