Order against BIAL stayed by High Court High Court Round-Up

State Information Commission says BIAL is a public company

BANGALORE: The Karnataka High Court on Thursday stayed by four weeks an order by the State Information Commission declaring that Bengaluru International Airport Limited (BIAL) is a public company.

Justice N. Kumar passed the order on a petition by Bengaluru International Airport Limited challenging the SIC order of May 14, 2008.

The SIC had acted on an application by Benson Isaac of Bangalore who had filed an application under Section 18 of the RTI Act seeking certain details from BIAL.

The commission had ordered notices to Bengaluru International Airport Limited on Mr. Isaac’s application and also referred it to a larger Bench.

BIAL had contested the SIC order, and said that it is not a public company and that it does not come under the provisions of the Right To Information Act (RTI).

Adjourned

Justice N. Kumar on Thursday adjourned a petition by former Member of Parliament from Chamarajanagar, A. Siddaraju, who had questioned the notices issued to him by the Public Works Department (PWD) asking him to pay higher rent for a room that he had occupied in the State Guest House.

Mr. Siddaraju said he was twice elected as MP from Chamarajnagar and had occupied Room No. 115 in Cauvery, the State Guest House, from July 1996 to May 1998.

The PWD, instead of levying rent at Rs. 20 a day, had billed him a higher rent and sent notices demanding that he pay up.

Justice N. Kumar adjourned further hearing on the case.

Justice N. Kumar adjourned further hearing on petitions by several lorry transporters challenging the seizure of their vehicles by the district administration of Uttara Kannada.

The petitioners, Mallijkarjuna and others, said the District Magistrate of Uttara Kannada had acted on complaints by 13 self-styled social workers and had asked the Regional Transport Officers of Karwar and Sirsi to initiate action against overloaded trucks that ply in their jurisdiction.

They said the social workers had complained of lorries carrying ore plying on the roads of the district and creating a nuisance to the people.

They said the Regional Transport Officers had seized their vehicles, claiming that they were overloaded. The petitioners urged the court to direct the RTO authorities to release the seized lorries.

No power from RMU

Justice D.V. Shylendra Kumar on Thursday directed the electricity authorities to stop power supply from an RMU and Switch set up on Residency Road adjacent to the front gate of Park Residency Hotel, Bangalore.

Contested

The Park Residency Hotel had contested the site of the RMU, saying that it posed a danger to its customers and also to the pedestrians.

The hotel had urged the court to direct the electricity authorities to shift the RMU and switch in public interest.
