A test of three Acts
A MINOR can always plead minority. Section 10 of the Indian Contract Act provides that all agreements are contracts if they are made by parties competent to contract, and Section 11 states that every person is competent to contract if he is of the age of majority. The Privy Council in Mohiri Bibi vs. Dharmodas Ghose held that minor's agreement is void ab initio. Thus a minor can always plead minority. The rule of estoppel does not apply against a minor.
