Interim stay on Sahara serial vacated

KOLKATA, June 30

MR Justice M.H.S. Ansari of the Calcutta High Court today vacated the interim order restraining Sahara Media Entertainment Ltd (Sahara) from telecasting the tele-serial Karishma — A Mircale of Destiny.

The court directed Sahara to furnish a security in the form of a bank guarantee of Rs 25 lakh within 4 weeks with the Registrar of the Calcutta High Court.

On the prayer of the counsel of Ms Barbara Taylor, Bradford, the court stayed the operation of its own judgment till July 7.

On May 8, 2003, Ms Taylor filed a suit alleging that Karisma - A Miracle of Destiny has been adapted from her own story, The Woman of Substance and the court passed an injunction restraining telecast of the serial. The matter went to the Division Bench, which vacated the order of injunction but Supreme Court again granted injunction and sent the matter back to the Calcutta High Court for hearing.

Mr S.S. Ray, the counsel, stated that the serial is based on an independent story and has not infringed the copyright as alleged. Mr Sachin Bhowmick, by a separate affidavit, has stated that the story is made from his personal experience about one of his friends, who has now become a textile baron in England. The story of Aparajita is his own product of experience, and not taken from anywhere.
