High Court order on reservations

HYDERABAD, MARCH 29. A Full Bench of the A.P. High Court,
comprising the Chief Justice, Mr. M.S. Liberhan, Mr. Justice G.
Raghu Ram and Mr. Justice V.V.S. Rao, on Wednesday made it clear
that the rule of reservation for SCs and STs and the BCs will
have to be made applicable not only for the 85 per cent seats
meant for the local area students but also the 15 per cent seats
which are for open competition.
The Bench was dealing with a case wherein a student seeking
admission to PG medical course complained to the court that the
authorities of NTR Health University were applying the rule of
reservation only to the 85 per cent seats meant for the local
area candidates. As per the Presidential order 1974, the State of
A.P. is divided into three areas and the 85 per cent seats in the
educational institutions in these areas are earmarked for local
candidates. The 15 per cent is treated as open seats wherein the
local and non-local candidates compete.
The Chief Justice, speaking for the Bench, said that the action
of the authorities in seeking to apply the reservation only to 85
per cent seats meant for local candidates was contrary to the
Presidential order and the PG admission rules.
