`Contempt of court' : HC issues notice to BMP

BANGALORE, OCT. 13. The acting Chief Justice, Mr. Ashok Bhan, and Mr. Justice R.Gururajan, constituting a Division Bench in the Karnataka High Court, today ordered issue of notice to Mr. K.Jairaj, Commissioner, Bangalore Mahanagara Palike (BMP), and Mr. Mahesh Babu, Assistant Executive Engineer, BMP, in a contempt of court petition filed by Mr. A.Krishnappa of J.P.Nagar, Bangalore, seeking a direction to the respondents for disobeying the orders of the court.

The petitioner stated that Government land measuring three acres was reserved for a park and open space for use by the residents of J.P.Nagar. Some persons encroached upon the land for constructing houses and residential buildings. The petitioner filed a writ petition in the High Court. The Division Bench of the court passed orders on February, 17, 2000 dismissing the petition and directing the BMP to ensure that no further encroachment took place. Even after the orders were passed, several constructions had sprung up in the park. The petitioner had made a representation about the construction, and the BMP officials had not prevented the erection of structures.

The judges adjourned further hearing.

Petition dismissed

Mr. Justice Mohammad Anwar today dismissed an election petition filed by Mr. M.P.Keshavamurthy of Anekal taluk, Bangalore District, challenging the election of Mr. A.Narayanaswamy to the Legislative Assembly from Anekal Reserved Constituency.

The petitioner had sought for inspection and recount of votes and to declare Mr. Narayanaswamy's election as being null and void, and to declare him (the petitioner) as being duly elected.

The petitioner stated that he had contested as a Congress(I) candidate and Mr. A.Narayanaswamy as a BJP candidate from Anekal in the election held on September 5, 1999.

The votes were counted on October 6, 1999, and the respondent was declared elected by a margin of 1,561 votes. The respondent had filed an application for dismissal stating that the petition did not disclose any cause of action.

After hearing the counsels for the parties the judge dismissed the election petition.
