SC ruling on trade union disputes
NEW DELHI, DEC. 4. In a major ruling favouring trade unions, the
Supreme Court has held that a person, who has applied to become a
member of a union, cannot raise a dispute against it before the
registrar of trade unions prior to a decision on his application.
The ruling came in a judgment by a Division Bench, comprising
Mr.Justice S. Rajendra Babu and Mr. Justice S. N. Variava, which
said that a dispute could only be raised before the registrar of
trade unions by a person who is a member of that union for at
least six months. This judgment set aside a previous Mumbai High
Court ruling that even a person, who has applied for becoming a
member, can raise a dispute under section 28 (1a) of the Trade
Unions Act.
