TNHB told to make efforts to settle compensation

CHENNAI, APRIL 14. The Tamil Nadu Housing Board (TNHB) and the
Housing and Urban Development Commissioner have been directed by
the Madras High Court to negotiate with the Thangam Colony
Welfare Association and others to arrive at a settlement for
payment of compensation for the ``super-structures to be
demolished'' for formation of a 60-feet road in Anna Nagar here.
Disposing of petitions filed by the Association president, Mr. P.
Kaliyaperumal and five others, Mr. Justice P.D. Dinakaran said,
``the settlements should be arrived at and a compensation paid
within three months''. The petitioners should surrender their
possessions to the TNHB on receipt of the damages, so that the
60-feet road could be formed as quickly as possible. He also
ordered maintenance of status quo till a mutually agreeable
settlement was arrived at.
The petitioners had moved the court seeking to quash the
Purasawakkam Tahsildar's order issued on August 29, 1991 to
acquire their lands for laying of the road at Sixth Avenue. The
super-structures on the identified lands should be safeguarded
while laying the 60-feet road, the petitioners contended.
In his interim order passed on February 7, 2000, the Judge wanted
to know from the Housing Board whether a ``single, two-way 60-
feet width'' was necessary, or two one-way roads of 30 feet each
would be enough. The Housing Board had responded saying that the
formation of a single, 2-way 60-feet road was ``indispensable''.
The Judge gave the direction, considering the larger public
interest involved and for protecting the claims and interests of
the petitioners.
