IT case proceedings against Sasikala stayed

CHENNAI, JUNE 15. The Madras High Court has granted an interim stay of all proceedings in the `Income Tax returns case' against the Chief Minister, Ms. Jayalalithaa's friend, Ms. N. Sasikala, pending before the Additional Metropolitan Magistrate Court, Economic Offences-I, Egmore. Allowing a petition filed by Ms. Sasikala's counsel, Mr. Jothi, Mr. Justice Malai Subramanian also ordered private notice and posted the matter for June 22.

Ms. Sasikala had challenged the May 30 trial court order permitting the Income-Tax department to mark 31 additional documents.

Seeking to set aside the EO Court-I order, the petition pointed out that though only three witnesses and 12 documents had been cited in the original complaint, the Assistant Commissioner of Income-Tax had filed three memos - on March 7 and 8, and May 28 - seeking to file 31 fresh documents.

The piecemeal submission of documents was contrary to the law and was not permissible under the provisions of the Criminal Procedure Code, the petition contended.

Ms. Sasikala has been charged with ``wilful failure'' to file income-tax returns for the assessment year 1990-91.
