PG medical course: HC upholds cut-off date

KOCHI, AUG. 6. A Division Bench of the Kerala High Court on
Monday upheld a clause in the prospectus of the post-graduate
medical courses which prescribed April 30, 2001 as the cut-off
date for eligibility for admission to the courses.
The Bench comprising Mr. Justice K. S. Radhakrishnan and Ms.
Justice A. Lekshmikutty while setting aside a single judge's
order, pointed out that the students who were governed by the
2002 prospectus could not contend that the fixation of the cut-
off date by the 2001 prospectus was wrong and arbitrary. The
single judge had proceeded on the basis of the 2001 prospectus.
The petitioners - three doctors who had passed the MBBS from
different universities in the State - were governed by the 2002
prospectus. The Government had fixed the cut-off date as per the
2001 prospectus. The petitioners who were 1995 batch students
were governed by the 2001 prospectus.
The entrance examination written by the petitioners on the basis
of 2001 prospectus following the single judge's direction, would
have no legal effect. They could take the examination to be held
on September 2.
