Gulshan murder case takes new turn
MUMBAI, AUG. 16. The controversy over examination of accused-
turned approver in the Gulshan Kumar murder case today took a new
turn with a sessions court deferring his deposition until further
orders on a plea made by the prosecution.
In a related development, the Special Public Prosecutor, Mr.
Ujjwal Nikam, informed the court that he would examine two key
witnesses, Mr. Kishen Kumar and Mr. Bhushan Kumar, brother and
son respectively of Gulshan Kumar, tomorrow.
Mr. Nikam urged the judge, Mr. M. L. Tahilyani, to defer the
trial as he would prefer to move the High Court here against his
order rejecting the prosecution's plea to treat the approver as
an accused and not as a witness in view of his hostile attitude.
The prosecutor said that grave prejudice would be caused to the
State if examination of the approver was allowed while the
defence lawyer Mr. Majeed Memon opposed the former's plea on the
ground that the trial would be prolonged and delayed further.
On August 13, the court had rejected the prosecution's prayer to
treat the approver as an accused and not as a witness.
The judge also returned the certificate issued by the prosecutor
withdrawing the pardon granted to approver Mohammed Ali Shaikh.
