T.N. CM case: SC order today
By J. Venkatesan
NEW DELHI, SEPT. 20. The Supreme Court will pronounce orders on
Friday on a batch of petitions challenging the appointment of Ms.
Jayalalithaa as Chief Minister of Tamil Nadu by the then
Governor, Ms. Fathima Beevi on May 14.
A five-Judge Constitution Bench comprising Mr. Justice S.P.
Bharucha, Mr. Justice G.B. Pattanaik, Mr. Justice Y.K. Sabharwal,
Mrs. Justice Ruma Pal and Mr. Justice Brijesh Kumar had reserved
orders on September 13 at the conclusion of arguments by counsel
for the parties for six days spread over two weeks. The Attorney
General, Mr. Soli Sorabjee, and other senior counsel had argued
that the Governor did not have an absolute or unfettered
discretion in the appointment of a person as Chief Minister under
Article 164 (4).
