No prosecution reply yet to Jayalalithaa plea

CHENNAI, OCT. 10. Mr. S.S.P. Darwesh, Special Judge-II, today pulled up the prosecution in the `coal import deal' case for not filing a reply to a petition by the former Chief Minister, Ms. Jayalalithaa.

Ms. Jayalalithaa had petitioned the court seeking permission to answer questioning under section 313 Cr.P.C. through counsel. The judge posted for yesterday the reply by the prosecution. But, it was not filed even today.

When Mr. Darwesh asked the prosecution why it had not submitted its position, the SPP pleaded personal reasons. He also said he had to consult the investigating officer who, in turn, had to discuss the matter with his superiors. Later, the judge said he was extending at the request of the prosecution the time for filing counter till tomorrow. No further extension would be granted, he cautioned. He adjourned the case to tomorrow for questioning of Ms. Jayalalithaa.

It is learnt she may appear tomorrow.

TANSI-R.R. Industries case

Meanwhile, the prosecution in the `TANSI-R.R. Industries land deal' case is likely to file in a few days the appeal against the order of Mr. P. Anbazhagan, Special Judge- III, rejecting the report filed by the CB-CID after conducting further investigation. The investigating agency had cited six additional witnesses and documents. But, the judge said the statements of the additional witnesses on property valuation were not supported by the documents filed.
