SC notice to CBI on Laloo's bail plea

NEW DELHI, DEC. 7. The Supreme Court today issued notice to the Central Bureau of Investigation (CBI) on the bail applications of former Bihar Chief Ministers, Mr. Laloo Prasad Yadav and Dr. Jagannath Mishra, who were sent to judicial custody for 15 days by a special court in Ranchi in the multi-crore fodder scam case after declining them bail.

A three-Judge Bench comprising Mr. Justice K. T. Thomas, Mr. Justice S. S. M. Quadri and Mr. Justice U. C. Banerjee asked the Solicitor General, Mr. Harish Salve, who accepted the notice on behalf of CBI, to file its response and posted the case for further hearing on Monday.

In his application, Mr. Laloo Prasad Yadav said that he was released on bail in three other fodder scam cases pending in a Patna court. Following the Supreme Court's order on November 5, Mr. Laloo surrendered in the court on November 26 and he was sent to judicial custody the same day.

Mr. Laloo contended that the special court's order was totally contrary to the apex court's direction issued in November last year that bail could be granted in cases where the allegations were similar and the accused had already obtained bail earlier.
