Election upheld

NEW DELHI, JAN. 10. A petition challenging the election of Mr. Kamal Nath, Congress leader, to the Lok Sabha from Chhindwara constituency (Madhya Pradesh) in 1998, is ``not maintainable'', a Bench of the Supreme Court has ruled.

The Bench had ``no hesitation in coming to the conclusion that ``material facts'' in relation to an allegation of corrupt practice'' of exceeding the `ceiling amount of election expenses within the ambit of Section 123(6) read with Section 77 of the Representation of the People Act(R.P.Act) - are lacking.''
