Clean chit to Cong. in donation case

NEW DELHI, JAN. 22. The Central Bureau of Investigation today gave a clean chit to the Congress in the matter of an allegation that it had received Rs. 3.5 crores as donation from some Non-Resident Indians in violation of the Foreign Contributions Regulation Act (FCRA) between 1993 and 1995.
Counsel for the investigating agency, A.K. Dutt, submitted before a Division Bench comprising Justice Devinder Gupta and Justice Shameet Mukherjee that the preliminary enquiry into the allegation had been closed on receipt of an opinion by the Attorney-General of India, Soli J. Sorabjee, on the merits of the case. The Attorney-General in his opinion said that no case was made out against the Congress.
However, the Bench could not admit the plea by the agency when counsel for the petitioner, Prashant Bhushan, submitted that the allegation was sustainable.
The Bench asked Mr. Bhushan to file an affidavit responding to the CBI's decision to close the case by March 1.
The matter has been pending before the court for the past five years following filing of a public interest litigation by a Patna-based journalist seeking a CBI inquiry into the allegation.
