Implement arrest guidelines: SC

NEW DELHI, FEB. 15. The Supreme Court today directed Uttar Pradesh, Madhya Pradesh, Rajasthan and Punjab to indicate the action taken against police and other officials who had failed to comply with its earlier 11 `guidelines' on arrest laid down in the D.K. Basu case.

A Bench comprising R. C. Lahoti and S. N. Phukan asked these States to ensure that the 1996 guidelines were implemented in letter and in spirit and a report filed within six weeks either by the Chief Secretary or the Home Secretary.

On October 19 last, the court had directed all the State Human Rights Commissions to conduct surprise checks on police stations to ensure whether the 11 guidelines were being implemented and file a report in this regard. Where the States had not constituted such a Commission, the High Court was asked to set up a committee for the purpose. During today's hearing of the case, the amicus curiae drew the attention of the court to the reports filed by the Commissions of Madhya Pradesh, Rajasthan and Punjab which had highlighted gross and serious human rights violations being reportedly committed by police and other officials in implementing the 11 guidelines on arrest.

It was also pointed out that in a big State like Uttar Pradesh, no State Human Rights Commission had been set up so far but the committee set up by the High Court had filed the report.
