Pensioners' woes

Sir, — The Centre has extended the increase of the fraction of pension to be commuted from one-third to 40 per cent also to the pensioners who retired on or after January 1, 1996 but received one-third before the issue of department of pension OM dated October 29, 1997 which provides the above said increases. The director, Postal Accounts, Chennai, increased the quantum of fraction from one-third to 40 per cent suo-motu in contravention of rule 5 (2) of Commutation of pension Rules, 1981. Realising the mistake after more than two years, he called for fresh applications from such pensioners and revised the commuted value based on the age following the date of fresh application. As a result, commuted value had decreased and the over payment was recovered from the normal pension. But neither DPA nor many pensioners realised the fact that deduction of pension to the extent of 6.67 per cent effected as a consequence of the revision of commutation had become redundant and such amount had to be refunded to the pensioners.

Deduction of 6.67 per cent of pension is due only from the date of revision of commutation based on the fresh application and date on which the amount already paid suo-motu stood adjusted in view that the revision of consequent deduction of such portion have become nugatory.
