A Bench comprising S.S.M. Quadri and S.N. Variava ordered the notice returnable in two weeks on the SLP filed by the Ragas Educational Society, Chennai. According to the appellant, the State Government issued a G.O. on September 9, 1996 seeking to regulate admissions to the post graduate MDS courses being offered by self-financing dental colleges and providing for 50 per cent reservation of seats to be filled by the State Government. A writ was filed by the society and others challenging the G.O. and a single judge declined to stay the order. A Division Bench which had stayed the G.O. on May 6, 1997 by its judgment dated December 20, last vacated it and sent back the petitions to the single judge for disposal. The SLP was directed against this judgment. The SLP seeking to quash the impugned judgment, submitted that several questions of law were involved in it, viz., whether the State Government could issue directions or legislate in respect of admissions to postgraduate courses and fix fees for such courses, when the field was occupied by the University Grants Commission and Dental Council of India.
