However, the court suggested to the Government to consider holding the test for all students, including those who had already taken the examination by giving them an option to write again if they gave an undertaking for cancelling the earlier exam. The suggestion was given by a three-Judge Bench, comprising Justice B.N. Kirpal, Justice Arijit Pasayat and Justice H.K. Sema after the Solicitor-General and counsel for the Gujarat Government, Harish Salve, informed it that a repeat examination would be held for all students who missed the April test. The Bench asked him to file an affidavit and posted the matter for further hearing on Monday. Earlier, Mr. Salve submitted that the petitioner, Lok Adhikar Sang, had rushed to the court on the basis of media reports which, he said, had no basis. The State Government was fully alive to the situation and would do everything to prevent students from being used for political purposes. Attendance at the X, XI, XII examinations was normal touching around 98 per cent against an average of between 96 and 97 per cent in the previous years. ``The decision of the Gujarat Government to conduct repeat examinations has been taken on account of the fact that unfortunately certain students were misled into abstaining from the examinations, which were held,'' he said. Mr. Salve also submitted that students in the relief camps had been provided free books and notebooks and teachers were also appointed to conduct coaching classes to prepare them for the examinations. The Bench suggested that the Government could do more. If the overall performance of the students came below the normal level, the moderation committee reviewing the results could do the needful to help the students. Mr. Salve said ``that goes without saying. But today, we cannot come out openly saying that the Government will review the results and take appropriate steps.''
