A three-Judge Bench headed by Justice B.N. Kirpal posted the matter for hearing on Monday when the SLP was mentioned before it on Friday by senior counsel, L. Nageswara Rao. The SLP will now be heard by a three-Judge Bench, headed by Justice G.B. Pattanaik. According to the petitioner, N. Anand, the election of office-bearers of the Madras High Court Advocates Association is to be held on April 30. (Besides, the president, R. Karuppan, P. Jayaraman, S.V. Jayaraman, N.G.R. Prasad and S. Prabhakaran are among those contesting). He said 829 lawyers out of 887 who applied for membership of the association were found eligible for admission and they were included in the voters list in accordance with the rules and regulations. A public interest petition was filed in the High Court challenging the election procedure and inclusion of the names of 829 lawyers in the list. The High Court by an order dated April 23 held that the 829 members could not be treated as members for the purpose of election and as a result they were held ineligible to participate in the elections. The SLP was directed against this order. The petitioner submitted that the High Court had committed an error in disqualifying the 829 members of the association who were included in the voters list in accordance with the rules. He prayed for an interim stay of the operation of the impugned order to enable the 829 members to participate in the elections scheduled for April 30.
