Madras High Court stays release of Hindi film

CHENNAI MAY 21. The release of Shahrukh Khan-Salman Khan- Madhuri Dixit starrer, Hum Tumhare Hain Sanam, has been stayed till May 28 by the Madras High Court today.

Justice A. Kulasekaran granted the interim stay on the release of the K.C. Bokadia film, after the Chennai-based Gemini Industries and Imaging Limited (formerly known as Gemini Pictures) filed a suit for the recovery of Rs. 32.88 lakhs loaned to Mr. Bokadia during 1999-2000.

The petitioner-company sought a permanent injunction restraining Mr. Bokadia from `releasing, screening or exploiting the picture anywhere without settling the dues'.

The petitioner contended that it had supplied eastman colour negative rolls on eight different occasions between July 24, 1999 and January 17, 2000, in addition to cheque payment of Rs. 10 lakhs for the production of the film.

Noting that usually film producers would settle the dues of every creditor prior to the release of a film, it said that when Mr. Bokadia was contacted after the announcement that the film was to be released on May 24, he expressed his inability to repay the sum.

When a petition seeking injunction on the film's release was filed in the City Civil Court here, defendant's counsel took time to file counter-affidavit. The matter was then posted to May 23. In the meanwhile, the petitioner-company said, ``it is gathered from the laboratory currently processing the picture that the defendants have made full arrangement to export the prints to various foreign countries and the prints have already been made for that purpose''. The film is directed by K.S. Athyiaman.

The petitioner also prayed for a direction to Mr. Bokadia to pay a sum of Rs. 32,88,200.80 as on the date of the complaint, together with a future interest at the rate of 36 per cent till the date of payment.
