President gives assent to CPC Amendment Act

NEW DELHI JUNE 4. The President has given assent to the Code of Civil Procedure (Amendment) Bill, 2002, which seeks to bring a milestone change in the procedure in suits and civil proceedings by way of reducing delays and compressing them to a year's time right from institution of the suit till disposal and delivery of judgment as against the existing norm which takes ages and generations. It has been notified as Act No. 22 of 2002.

It also amends the 1908 Act. With this, the long felt need of the litigants and the lawyers for speedy disposal of suits would be fulfilled.

The President has also given assent to five other Bills and they have been notified as Acts: the St. John Ambulance Association (India) Transfer of Funds (Repeal) Act seeks to repeal the principal Act of 1956 as it has become redundant; the Vice-President's Pension (Amendment) Act seeks to amend the principal Act of 1997 in order to provide for 50 per cent of the pension as admissible to the retiring Vice-President to his spouse for the remainder of her life.

The Act also enjoins the Government to provide the spouse of ex-Vice-President or Vice-President who dies in harness, unfurnished residence without payment of licence fee for the remainder of her life.

The Indian Succession (Amendment) Act seeks to provide a Christian widow distributive share in the property bequeathed by her deceased husband as also end discrimination against her. The Act also revises the principal Act known as the Indian Succession Act, 1925.

The Constitution (Scheduled Castes) Order (Amendment) Act, 2002, seeks to amend the original Act of 1950 to include Mangali in Koraput and Kalahandi districts of Orissa and Mirgan in Navrangpur district of that State in the category of Scheduled Castes.

In Punjab, Chamar, Jatia, Rehgar, Raigar, Ramdasi, Ravidasi, Ramdasia, Ramdasia Sikh, Ravidasia, Ravidasia Sikh have been included as Scheduled Castes. In West Bengal, Hari, Mehtar, Mehtor, Bhangi and Balmikli and Chain in Malda, Murshidabad, Nadia and South Dinazpur districts have been included among Scheduled Castes.

The Tea Districts Emigrant Labour (Repeal) Repealing Act seeks to repeal the 1970 Act as it has outlived its utility.
