Life term for 13 in hooch tragedy case

KOLLAM July 16. While the noose has been spared for all the 26 persons convicted in the Kalluvathukkal-Pallikkal-Pallipuram hooch tragedy case, 13 of them were today sentenced to "imprisonment for life'' plus fine by the Kollam First Additional Sessions Judge, K. Chandradas Nadar. Thirty-one persons had lost their lives in the tragedy.

Those given the life term include accused number 1, Hyrunnissa alias Thatha, accused number 7, Chandradas alias Manichan, accused number 4, Manikandan alias Kochani who is Manichan's brother, and their younger brother, Vinod, accused number 8.

Manichan was sentenced to life after being found guilty of murder under Section 302 of the IPC and 57(A) of the Abkari Act.

Kochani and seven others were sentenced to life after being found guilty of murder under Section 302 of the IPC. Hyrunnissa and three others were given a similar sentence after they were found guilty under Section 57 (A) of the Abkari Act.

Citing a Supreme Court ruling, the judge made it clear in the judgment that the life term awarded to the 13 would mean "life-long imprisonment'' unless the Government gives a remission. All of them were also sentenced to additional years of imprisonment under various other offences of the IPC and the Abkari Act. However, the prison sentences will run concurrently.

In Manichan's case, he has been sentenced to 43 years' imprisonment over and above the life sentence. He was also sentenced to pay a fine of Rs. 30.45 lakhs.

In case of default in paying the fine, he will have to undergo a default sentence of 18 years and six months' jail term. The fine has break-ups for each offence. The imprisonment for default too has break-ups ranging from three months to five years.

In addition to the life term pronounced against her, Hyrunnissa will have to serve a prison term of 17 years, to run concurrently, and pay a fine of Rs. 7.55 lakhs.

In the event of default in paying the fine, there will be a default sentence of seven years.

Three others convicted similarly along with her under Section 57 (A) of the Abkari Act will have to serve the same sentence.

They are accused number 25, Suresh Kumar, accused number 30, Manoharan and accused number 42, Sajeendran.

Kochani will have to serve a prison term of 11 years to run concurrently with the life term and pay a fine of Rs.7.45 lakhs. Failure to pay the fine will invite a default sentence.

His brother, Vinod, and accused number 16, Anil Kumar alias Ani, have been given a similar sentence.

The others convicted to life are Anil Kumar (5), Mohammed Shabu (11), Manichan's manager Balachandran (15), Vijayan (20) and Suresh alias Shankaran (22). Hyrunnissa's husband, Rajan (2) and employee, Raju (3) have been sentenced two-and-a-half years' imprisonment and a fine of Rs.1.05 lakhs each carrying a default sentence of 13 months.

The judge also pronounced that in the event of the fine imposed on those convicted being collected, Rs.1 lakh each will have to be paid to the dependents of those killed and the same amount to those who had lost their eyesight in the tragedy.

Accused number 27, Shyjan, who turned approver during the course of the trial, has been acquitted and orders have been issued in the judgment to register a case against the four witnesses who had turned hostile during the witness examination procedure.

The judge is of the opinion that the four had misguided the Court.
