Without specifically mentioning the `premises' where they intend to conduct the search, the petition, filed on behalf of the Madurai Q Branch DSP, Mahendran, sought a warrant for Mr. Vaiko's premises alone. The newly appointed Special Public Prosecutor, S. Jayakumar, was not present when the petition came up before the Special Judge, L. Rajendran. The judge is expected to pass orders on Tuesday. Strongly opposing any such general search, the MDMK legal wing secretary, Devadoss, said since the entire case rested only on an alleged pro-LTTE speech delivered by Mr. Vaiko at Tirumangalam, the investigating agency's plea to search the leader's premises was mala fide. Moreover, as per the FIR, the Tirumangalam Inspector of Police, Thangavelu, had in his possession the `incriminating audio as well as video evidence' to the alleged offence. While this is so, the present search plea appeared to be a plot to `create an evidence' by planting incriminating material at the premises during the search, Mr. Devadoss apprehended. In the event of granting any permission to search Mr. Vaiko's premises, either the judge himself should be present during the operation, as provided for under Section 103 of the CrPC, or should allow advocates to be present, Mr. Devadoss said. Alleging ulterior move behind the Q Branch petition, he said when the Tirumangalam court had already rejected such a plea, the investigating agency need not press it further.
