Panel asks Centre to scrap ESMA

NEW DELHI AUG. 16. The second National Commission on Labour has asked the Government to scrap the Essential Services Maintenance Act and has suggested an alternative system to ensure essential services were not disrupted even in the event of a labour dispute.

According to the report submitted to the Government, the new mechanism, even in the event of "strike'' would not lead to the workers absenting themselves from duty. This would facilitate maintenance of services vital to society.

In the case of socially essential services, such as water supply, medical services, sanitation and electricity, if a dispute arises and is not settled through mutual negotiations, the workers might go on a strike.
