Gonvindasamy was detained on December 20, on a direction from the Collector. The order said if he was allowed to remain at large he would endanger the maintenance of public health by selling illicit liquor. On January 8, 2002, the detenu sent a representation to the Government. The Collector failed to send his remarks on the representation as well as two reminders sent by the Government. After waiting for his remarks for more than a month, it rejected the representation on February 10. Meanwhile, Gonvindasamy moved the court for quashing the detention on the `short ground of non-consideration of the representation expeditiously.' Allowing the petition, a Division Bench comprising Justice N. Dhinakar and Justice A. Packiaraj said: ``we place on record our strong disapproval of the conduct of the Collector for not sending his remarks to the Government. Inspite of two reminders, he did not care to send his remarks and on account of the lapses and indifferent attitude on the part of the Collector, the representation could not be considered expeditiously. We are, therefore, constrained to set aside the order passed by him''.
