Sir, The Chief Election Commissioner, J.M. Lyngdoh, is perfectly correct in certain respects and perfectly wrong in certain others. He has the Constitutional authority to schedule the Gujarat Assembly election for January 2003. The Chief Minister of Gujarat, Narendra Modi, can only suggest a period before which the election should be conducted but cannot force the CEC to agree to his date. However, the CEC had recommended the imposition of President's rule before the elections. The Central Government takes the decision on President's rule based on the report of the Governor according to Article 356. The CEC has no locus standi to recommend President's rule. S.V.
