An affidavit containing the apology was submitted before the Division Bench comprising Justice R. M. Lodha and Justice Dilip Bhosale, who had earlier fixed the hearing on October 17. Ms. Koirala was directed to file the affidavit by October 5, but could not do so as she was admitted to the Lilavati Hospital, following an injury sustained during a film shooting. The defence advocate, Satish Maneshinde, had told the court during the last hearing that the draft affidavit was ready, but she could not sign it as she was hospitalised. He had submitted that Ms. Koirala hailed from Nepal and since, the Koirala family has social connections with the Thackerays, she had thought it appropriate to seek his help. Mr. Nair had also tendered an apology after the court had issued contempt notices objecting to the two seeking intervention of an "extra-constitutional authority" for resolving the dispute, when the matter was before the Bench. The court had, however, exempted Mr. Nair and Ms. Koirala from personal appearance. The two had approached the Sena chief last month.
